O’Fallon, Mo., man sentenced to treatment for fight, DWI
An O’Fallon, Mo., man was sentenced Monday to attend a St. Charles County in-custody treatment program.
We wrote earlier about the case of James P. Conley, 29, who was accused of tearing off part of a man’s ear during a fight in March. Conley, formerly of the 2500 block of Breezy Point Lane, already had pending charges of possessing a loaded firearm while intoxicated and driving while intoxicated when the fight occurred.
Conley is the son of O’Fallon City Councilman Pierce Conley. News of the assault broke when his father was running for mayor.
James Conley pleaded guilty in July to the alcohol-related charges and a felony assault charge stemming from the fight. He was sentenced Monday morning.
Circuit Judge Nancy Schneider held the sentencing hearing at her bench Monday morning, where most of the proceeding could not be heard from the gallery.
Assistant prosecutor Steven Kobal asked for concurrent sentences of four years on the alcohol-related charges and a consecutive five-year sentence on the assault charge. Prosecutors took no position on treatment programs, which can end with probation.
Schneider followed Kobal’s recommendation on the sentencing, but she suspended it so James Conley could report to an in-custody treatment program in St. Charles County. Kobal said the program requires at least 60 days in jail without work release. The program then continues for another 60 days in which the defendant may be released.
At the end of the program, the defendant can be placed on probation. If James Conley fails to complete the program, or if he violates probation after treatment, he could be sentenced to nine years in prison. Regardless, he will have felony convictions on his public record for each of the offenses.
David A. Dalton II represented James Conley. Pierce Conley, who attended the hearing along with his wife and daughter, declined comment.

Great job raising your son Pierce!!!
My, oh my! How slanted can this coverage get?
Anyone that knows this family is aware that the son suffered a serious head injury a couple years ago in an auto accident and has had issues since. Prior to the accident, there were no problems with the son. Also, this situation was triggered by the infidelity of his wife. Still, the behavior was horrible and unexcusable…but provoked!
Shame on ANYONE who tries to use this tragedy politically or as a means to smear the character of other family members!
Karma, oh guilty parties, KARMA! This could happen to any family! Beware those who throw rocks!
Best wishes to the Conley Family…there are many that still remember you in their prayers. Such a sad twist for anyone’s life!
boomboy2009 - Talk about slated… come on. Could you be any more slanted?
First, you are right this shouldn’t be used politically but I would like to even up your slant.
The accident you talk about happened because he was drunk and decided to get out of a moving car. So there were issues, alcoholism seems to be a good bet but I’m not a doctor. But I’m sure you have an excuse for that too.
Finally, infidelity does not justify biting someone’s ear off. Breaking up with someone or divorcing them sure, but not biting the ear off their new boyfriend. So don’t even begin to tell us it was provoked.
ok come on-
We said the same thing. Alcoholism and extreme idiotic behavior - whatever the case, the guy needs help and accountability - which he is getting. It should not be used to further hurt people because of political differences. There needs to be a line. O’Fallon has a bad problem with the separation of political and personal.
