Wal-Mart decision affects more than just the injured family

This didn’t affect only the Shank family.  A precedent was set for all of the rest of us.  Any of our employers can now sue us for any money we collect in a settlement to cover their expenses, medical or legal.  Not only are all of the Wal-Mart employees in peril, but every American. I will never step in a Wal-Mart again.

How do you feel about the lawyers who took about half of the Shank families judgment?

On a more serious note, what contracts should we honor? Sign an adjustable rate mortgage that you cant afford, ignore it when it comes due. Sign up for an insurance policy that specifically states if you are awarded a judgment that monies spent must be paid back then complain about it when it effects you? What happened to your word meaning anything?

Si Vis: I partly agree with you: What about the employees who sign up for an employer provided insurance plan who never see (and are never given) the actual policy documents. Have you ever tried to obtain such a document? I’m sure the fine print of most employer provided medical insurance policies indicate that the policy holder is the employer, not the employee. They carry the policy in the employees behalf.

On the mortgage fiasco, I’ve held from the beginning that the bankers who made these insane loans are the ones who messed up, and they should fail and not be bailed out. Time was (and it’s not that far past) where a mortgage banker wasn’t afraid to say to a potential customer: “I can’t give you this loan. You haven’t got the ability to pay.” It appears that rarely happens anymore.

We bailed out the mortgage bankers by backing JP Morgan in it’s buy of Stearns.
Seems its socialism for the rich, and cutthroat capitalism for everybody else.
Fascism, anyone?

Ms. Troupin.. The only precedent Walmart is setting is to cave in to unfair and wrong headed people such as yourself. Employer insurance policies have included this clause for my entire working life. Health insurance claim forms specifically ask if the claim is the result of an accident. They then ask if a settlement or judgement is being sought from a third party.

The tragedy for the Shank family is heart breaking. The only winners are the lawers who profit at every step in the process. Those faking human concerns and using this tragedy to advance their personal Walmart bashing agenda are pathetic.

Funny how people blame Walmart, but the blood-sucking lawyers get a pass every time. No one is bitching about the leeching attorneys taking half of the Shank family settlement. NO, they deserve that, right…they worked soooo hard for that money.

I WILL shop at Walmart just because RIGHT IS RIGHT, AND WRONG IS WRONG. The employee signed an agreement with Walmart/Medical Insurance stating that if money was won in a settlement for injury outside of the workplace, the medical bills would have to be reimbursed. I don’t see what is wrong with that statement. If the Shanks would have lost the case, Walmart would have paid for all of the medical bills…but I guess since Walmart has a lot of money, people think that extortion is okay.
