Appeals court upholds Mo prisoners’ right to abortion
Ironically, on the anniversary of the Roe v Wade decision, the federal 8th Circuit Court of Appeals has weighed in on the longstanding case involving a Missouri prisoner who sued the state a couple years ago when she was denied access to abortion.
A lower court sided with the woman, who did get the abortion.
The appeals court disagreed with some of the lower-court judge’s conclusions, but agreed with the main point that abortion access needed to be made available for prisoners.
Gov. Matt Blunt just weighed in with his reaction:
“State law prohibits the use of state tax dollars to facilitate abortions and I am very disappointed by this decision.
“Over the last three years, we have made positive changes in Missouri and enacted laws that reflect our profound respect for the inherent dignity of each and every life. I am hopeful and prayerful that we can further protect life by enhancing our laws to defend the dignity of human life.”


How will Nixon waffle on this issue?
I remember a time when the legislature had to hire outside counsel to defend the state law which prohibited state funding to abortion providers (Planned Parenthood) because Nixon wouldn’t defend the statutes.
Amazing that an attorney general can pick and choose which laws he wants to uphold based upon his political beliefs!

What is it that Nixon should have done differently? Do you have any ideas concerning the case or mindless political chatter? Tell us how you would have argued the case differently.
He defended the state with the arguments presented based on security provided by the Department of Corrections. If you want to be mad at someone be mad at the client, not the attorney.
You should probably understand the process better, Noni and Monkaton. I didn’t mention this particular issue, but brought up one not too long ago.
Defending the law is one thing, but it’s the amount of fight you’re willing to give that creates problems. In the 90s, he wasn’t so vigorous at doing so. Maybe now that he’s running for governor, he realizes his job.
Do you really want to defend a democrat attorney general who had to have a democrat-controlled legislature hire outside counsel to do his job?
