Avery bows out

Rep. Jim Avery, R-Crestwood, withdrew today from his race for re-election to the 95th District House seat.

“I need a break from elected office,” Avery said in an interview. Between serving in the House and in the National Guard, “I haven’t been home much.”

Avery was first elected in 2002, so could have served one more term before being forced out by term limits.

His departure leaves Republican Mike Leara alone in the race, unless someone else surfaces within the next hour. Filing closes at 5 p.m.

UPDATE: Democrats plan to find a candidate to field in the race, said Rep. Rachel Storch of St. Louis, the chief recruiter for House Democrats. By law, filing remains open until Friday since Avery dropped out so close to the deadline, she said.

What’s the citation on that law? As long as there was one candidate registered prior to close of filing it shouldn’t matter whether another withdrew.

Looking at the SOS site, a democrat did file but they filed after the closing deadline. That should be a challengeable issue. The person is obviously place holder.

Of course Avery should have been a little smarter and withdrawn a week or so from now and then there wouldn’t have been an issue.

State law does allow for such an extension. RSMo 115.361 provides for such relief when any candidate drops out within 2 days of the closing.

This law is known as the Treppler-Yeckel law, as State Senateor Irene Treppler years ago dropped out of the race (she was the only one filed) during the last hour of filing and her friend Anita Yeckel filed as Treppler rescinded her filing. After that, they passed legislation so someone could not ‘pass along’ a seat to another with last minute unfiling and filing.

Bet we see Avery with some cushy state job sent his way by Mike Gibbons.

Jim will be sorely missed… Noble person and always honest. You won’t find too many people out there with the kind of pride and responsibility that Jim carried. He didn’t fit the Jefferson City mold and was a true statesmen as well as a soldier. It was a great personal pleasure of mine to work with him. I wish him the best in his future ventures.
