Connie Johnson’s court date is a definite maybe

A judge is due to hear arguments today on State Rep. Connie Johnson’s eligibility for the State Senate, but whether those proceedings will actually take place remains to be seen.

As reported in the Post-Dispatch, court documents and other records suggest that Johnson has been staying with her ailing mother at a home in the city’s West End - which is both outside the House District she represents, and the State Senate she is seeking to represent.

One of Johnson’s two rivals from within the party - State Rep. Robin Wright-Jones - filed a lawsuit challenging her residency status.

A trial-by-judge was originally set for today, but, since then, three judges have recused themselves, leading the state Supreme Court to appoint a special visiting judge from Pulaski County.

Johnson’s lawyer, Rufus Tate, has filed a motion to get the case thrown out, arguing that election laws entitled her to a hearing weeks ago. If his motion is denied in Circuit Court, Tate says he will walk the pleading over to the State Appeals court downtown.

In other words, lots of things can happen today.

I remeber the issue came up when Kit Bond ran for Governor when he was living in Georgia. The Missouri Supreme Court said that Bond’s residence was where he said it was, regardless of where he was physically domiciled at the time he filed or ran. If Kit Bond can run for Governor when he was living in Georgia, Ms. Johnson, who has been taking car of her mother, can run for the State Senate.

The issue also came up in 2000 with then Vice President nominee Dick Cheney, who was living in Texas, where George Bush was living. Apparently an issue developed about Cheney’s residency, and it was resolved to be where he said it was.

Jake, thanks for the deletions. Those messages that only seek to disparage people have no place in the discourse of how an candidate or elected official will impact the lives of those they serve.

As it has been said: “When Clinton lied, nobody died.” But some in the media would have us believe that his personal indiscretion had some impact on the country - it didn’t. Yet when Bush/Cheney sought to send our nations children into harms way very few in the media batted an eye.

Continue to stick with the real stories Jake and we will continue to support you in your writing. Let’s discuss issues and not personalities!!!
