UPDATED:Walton knocked off state Senate ballot

According to the Secretary of State’s Web site, state Rep. Juanita Head Walton was removed yesterday as a candidate for the state Senate in District 13.

Her removal apparently has nothing to do with a lawsuit that the U.S. attorney’s office filed last fall against Walton, husband Elbert Walton and others for unpaid federal taxes of $41,035 for the 2002-2005 tax years.

Instead, she was removed from the ballot after the state Department of Revenue determined that Juanita Head Walton had been among the officers of a now-defunct corporation, El-Juan Group Inc., which ran a fee office in Charlack for about 15 months in 1993-94.

The state had won a judgement of almost $40,000 against the firm in 1997, but it was never paid, a Revenue spokesman said. Walton says it was paid.

Then-Gov. Mel Carnahan closed down the office, for alleged poor service and missing receipts. At the time, the Waltons denied any wrongdoing.

In separate interviews today, both Waltons said they expected to get Juanita Walton’s name back on the ballot. She’s seeking to oust state Sen. Tim Green, D-Spanish Lake, in the Aug. 5 primary.

Green filed the formal complaint that led to the Revenue Department’s findings, which then led to Secretary of State Robin Carnahan’s action.  A Carnahan spokesman said the removal is required, under a 2007 state law mandating a candidate’s ouster if they haven’t paid their state taxes.

Green said he filed the complaint because, “I work, I pay my taxes and I run for office. Why should people who abide by the law be treated differently from people who don’t?”

Elbert Walton is acting as his wife’s lawyer. The two expect to be in federal court today; she filed a suit Monday challenging the state law mandating removal of candidates for delinquent taxes.

Originally, the suit was filed in state court. Elbert Walton said they moved the suit to federal court because “we feel we’ll get fairer treatment” than in state court.

Walton accused Green and the state Democratic Party of being in cahoots, and asserted that racism was involved. Green and a state party spokesman denied any collusion, and rejected any accusations of racism.

St. Louis Oracle - based on your comments, I am beginning to wonder if you retired from law or were asked by the bar association to stop practicing law. It’s progressives/liberals like you that drive me crazy. Instead of filing a lawsuit, maybe Walton and her husband should just pay their taxes and stop cheating the system. As a black male, I think civil rights lawsuits should only be filed when real civil rights are violated. No one likes to pay taxes, but it is part of our civic responsibility to do so.

Why should the fact that someone’ spouse owes taxes, disqualify a person from running for office? Why should a person be punished for something that the spouse is fully responsible for. This is just another ploy to depress the African-American Community. This IS a Civil Rights issues, definitely. I, too, expect a lawsuit.

White people make millions of dollars and no one ever complains. Some people cannot stand to see an “Intelligent Black Man” or woman doing well and earning decent a living, by working everyday. Maybe if some of his “haters” got a law degree they could make a decent living, as well. GO ATTORNEY WALTON, GO GET EM!!!

Joyce - If you’d read before you post, you’d know that the lawsuit was filed “against Walton, husband Elbert Walton and others for unpaid taxes.” So apparently, it isn’t just her husband.

Nobody has a problem with an “intelligent black man” earning a decent living. Indeed, the Roberts brothers have earned far more, working their way up to amongst the most wealthy people in St. Louis. And they get nothing but applause for a job well done. Walton, on the other hand, is a leech and an instigator.

Sorry, Joyce, but just because he’s black doesn’t make it a civil rights issue. If he and his wife paid their taxes like the rest of us do, she’d still be on the ballot - and you’d be looking for something else to complain about.

Nick Kasoff - Why is the name Elbert Walton in bold print, If the relevent party is Juanita?
Juanita may or may NOT owe taxes - however, the focus, thus far, has been the fact that HER HUSBAND may or may not owe taxes. The majority of the comments are about Mr. Walton and not the pertinent issue at hand. Was the disqualfication “legal” or not IS this a violation of one’s civil rights?

And, you need to read….because there is nothing in my comment that associates Juanita’s being black with my feeling that the disqualification is a violation of her civil rights. That establishes your mind set. Read, again, please. GO ELBERT & JUANITA GO!!!

That trash needs to pay their taxes like the rest of the American population. These type of people always feel they should be exempt from paying anything….everything should be free to them…never changes….we owe them …they owe us nothing.

The original post just refers to “taxes” without specifying what kind of taxes. Joint liability of both husband and wife can arise from a joint income tax return (federal or state), real or personal property tax levied on jointly owned real estate or vehicles, or business or payroll taxes from a business in which both are partners.

Note that the observation “Her removal appears linked to a lawsuit that the feds have filed against Walton, husband Elbert Walton and others for unpaid taxes” was Jo’s take, not part of any official explanation. The key word is “appears.”
