According to the Secretary of State’s Web site, state Rep. Juanita Head Walton was removed yesterday as a candidate for the state Senate in District 13.

Her removal apparently has nothing to do with a lawsuit that the U.S. attorney’s office filed last fall against Walton, husband Elbert Walton and others for unpaid federal taxes of $41,035 for the 2002-2005 tax years.

Instead, she was removed from the ballot after the state Department of Revenue determined that Juanita Head Walton had been among the officers of a now-defunct corporation, El-Juan Group Inc., which ran a fee office in Charlack for about 15 months in 1993-94.

The state had won a judgement of almost $40,000 against the firm in 1997, but it was never paid, a Revenue spokesman said. Walton says it was paid.

Then-Gov. Mel Carnahan closed down the office, for alleged poor service and missing receipts. At the time, the Waltons denied any wrongdoing.

In separate interviews today, both Waltons said they expected to get Juanita Walton’s name back on the ballot. She’s seeking to oust state Sen. Tim Green, D-Spanish Lake, in the Aug. 5 primary.

Green filed the formal complaint that led to the Revenue Department’s findings, which then led to Secretary of State Robin Carnahan’s action.  A Carnahan spokesman said the removal is required, under a 2007 state law mandating a candidate’s ouster if they haven’t paid their state taxes.

Green said he filed the complaint because, “I work, I pay my taxes and I run for office. Why should people who abide by the law be treated differently from people who don’t?”

Elbert Walton is acting as his wife’s lawyer. The two expect to be in federal court today; she filed a suit Monday challenging the state law mandating removal of candidates for delinquent taxes.

Originally, the suit was filed in state court. Elbert Walton said they moved the suit to federal court because “we feel we’ll get fairer treatment” than in state court.

Walton accused Green and the state Democratic Party of being in cahoots, and asserted that racism was involved. Green and a state party spokesman denied any collusion, and rejected any accusations of racism.

Here’s how the situation stands on the Secretary of State’s site:

Why are these black politicians who are cheating, and getting caught screaming FOUL? Walton was not going to beat Green, he did her a favor. I do believe Green got elected by the same blacks who could possibly be discriminated against in a bogus suit. As we rememberd the assasination of Dr. King it would be travesty for a blackman to bring a discrimination suit for his poliical and financial failures. As a BLACKMAN I have no problem calling a spade a spade.

Can Juanita Walton run as a write-in in the general election, or will the month she spent on the ballot count as having sought a nomination for this office?

The Missouri Department of Revenue confirmed that Juanita owes nearly $40,000 in unpaid state taxes. The IRS has also filed a lawsuit last year against Juanita to recover an additional $41,000 in Federal income taxes and alleges that Juanita and Elbert set up a sham transaction to hide their assets. Everyone has to pay taxes and the Walton’s should not be treated any differently.

Phil -
Trash? What?
First of all..everybody does not pay taxes. People have different reasons why their taxes have not been padi. If everybody paid their taxes…there would be no need for the Tax Relief Attorneys who advertise on TV, everyday. So, do not speak of things that are not entirely true.

If you rob 40 grand from the bank you go to prison but if you steal 40K from the people (unpaid taxes) you get to run for office. The Walton’s are a sad joke. We should expect more from our politicians, at least they should have to pay their taxes in order to run and hold office.

Joyce you sound like you live under an algae rock…”"everybody doesn’t pay taxes”"-what kind of a statement is that?? Twisted for sure.. And does everybody set up a sham operation to shield their assets and income from taxation? If you can’t pay your taxes, go to the pokie where you belong low-lifes.

The racist remarks only prove that… WHITE people REALLY cannot stand to see an “Intelligent Black Man or Woman” doing well for themselves. Sorry, but, you may as well get used to it - cause African-Americans and the Waltons are here and here to stay.

And, “no” the rest of America does not pay their taxes. That is obvious. Whether you want to agree or not. A lot of people do not even file Tax Returns. You can call people names and you can complain - it does no good.

Again: whether or not the Waltons paid or did not pay their taxes is not the issue - you just want to make a Black man (woman) look bad, but, it’s not going to work. Black people see right through this.

Elbert and Juanita have done so much for the Black Community that a lot of you simply cannot stand it.. Just get used to it. They are going to keep helping the community, black and white - regardlesss.

Joyce- maybe you need an audit!

Hopefully those darn tax-evading vagrants will go to the state pententiary for a very long duration…let’s set an example how blacks exploit whites with reverse racism. “I’m black, I don’t need to pay my taxes, that’s racist making me pay my taxes, how unfair.”

Get Real, Grow Up, Be a True American and Pay Your Fair Share Pond Scum.

Rick James
You are a disgrace letting someone else lead your mind.
You are speaking as if the Waltons said that they were filing a Civil Lawsuit.
You are speaking to something that a total stanger has said, not even knowing the facts.
You do not know what the Waltons plan to do or why.
Shame on you for NOT geting the facts and for NOT calling a spade a spade.

And, to those of you making racist remarks…
Black Power!!!!!!!!!!!!!!!!!!!!!!!!!!
