UPDATED:Walton knocked off state Senate ballot

According to the Secretary of State’s Web site, state Rep. Juanita Head Walton was removed yesterday as a candidate for the state Senate in District 13.

Her removal apparently has nothing to do with a lawsuit that the U.S. attorney’s office filed last fall against Walton, husband Elbert Walton and others for unpaid federal taxes of $41,035 for the 2002-2005 tax years.

Instead, she was removed from the ballot after the state Department of Revenue determined that Juanita Head Walton had been among the officers of a now-defunct corporation, El-Juan Group Inc., which ran a fee office in Charlack for about 15 months in 1993-94.

The state had won a judgement of almost $40,000 against the firm in 1997, but it was never paid, a Revenue spokesman said. Walton says it was paid.

Then-Gov. Mel Carnahan closed down the office, for alleged poor service and missing receipts. At the time, the Waltons denied any wrongdoing.

In separate interviews today, both Waltons said they expected to get Juanita Walton’s name back on the ballot. She’s seeking to oust state Sen. Tim Green, D-Spanish Lake, in the Aug. 5 primary.

Green filed the formal complaint that led to the Revenue Department’s findings, which then led to Secretary of State Robin Carnahan’s action.  A Carnahan spokesman said the removal is required, under a 2007 state law mandating a candidate’s ouster if they haven’t paid their state taxes.

Green said he filed the complaint because, “I work, I pay my taxes and I run for office. Why should people who abide by the law be treated differently from people who don’t?”

Elbert Walton is acting as his wife’s lawyer. The two expect to be in federal court today; she filed a suit Monday challenging the state law mandating removal of candidates for delinquent taxes.

Originally, the suit was filed in state court. Elbert Walton said they moved the suit to federal court because “we feel we’ll get fairer treatment” than in state court.

Walton accused Green and the state Democratic Party of being in cahoots, and asserted that racism was involved. Green and a state party spokesman denied any collusion, and rejected any accusations of racism.

Joyce – You do not have a monopoly on the Black voice or any voice, especially not in North County! When a woman or man uses the color of our skin to get special treatment and avoid paying our taxes that is simply wrong, The Walton’s are NOT representative of all black folks. Not on my street… not in my neighborhood… and not in my church. Shame on the Waltons! I, as a black woman, will never defend these crooks!

Juanita wasnt going to win anyway, the Waltons turned this into a race issue, the whole unity pac is a scam look what their doing to the Normandy fire district. and tim green has plenty of support from whites and blacks in the 13th. unity pac cant even win in Jennings the good people of Jennings didnt buy into Unity Pacs racist message, what makes you think they can win in the 13th senate district with their racist politics?

Thanks Paula S for your voice of reason. I recently followed another case that attempted to throw a man (white, no less) off the ballot for non-payment of personal property taxes. This affects all parties, all races.
By “this”, I refer to state statute that states one cannot run for office and be deliquent on taxes. I think the reasoning behind these laws isn’t to punish the poor, minorities, or women but to ensure that the people who make the tax laws and spend the tax money are also paying into the system as required.

Isn’t it a bit hypocritical to think otherwise, or to accept that state senate paycheck when one does not pay into the system?

One more thing…

There are also regulations that keep one from being employed by the state if back taxes are owed. Same reasoning…why should you accept a state paycheck if you are not paying your taxes?

Funny how Walton complains that this is racially motivated, when they co-founded an organization “to help elect more African-Americans to office in North County.” Isn’t THAT racially motivated? Sounds like, as Rev. Wright said, their chickens are coming home to roost.

These two have been a joke and an embarassment to the party for years. They have raised their noses to any and all the accusations (which most were true) and anyhting to do with people who are not of color in North COunty. The sad part is that there are numerous African Americans who get involved in politics in North County that these two try to label as uncle tom’s and such. I hope she stays off the ballot and if she doesn’t we will do all in our power to defeat her and any other of these Unity PAC clowns with both white and African American candidates that really want to do good for the area.

Joyce may have a point. Why has senate candidate Neal St Onge not been knocked off for his unpaid taxes? sounds like selective application of the law to me.
