Donnelly sues for recount in AG’s race

Democrat Margaret Donnelly has gone to the courts in hopes of overturning her narrow loss to Chris Koster in this month’s Democratic primary for attorney general.Margaret Donnelly

Donnelly lost to Koster by about 780 votes out of roughly 346,000 votes cast. Koster’s victory percentage, if it stands, is 0.2 percent.

The lawsuit, filed Monday, will seek to re-count all votes, including “rejected absentee and provisional ballots,” according to a statement from the law firm Lathrop and Gage, which is representing Donnelly in the case.

The firm said the race was the closest in Missouri history, claiming that, if just one vote goes Donnelly’s way in a quarter of the state’s precincts, then Donnelly will be the victor.

“We are following the procedure that the state has established, so at this point it is a legal proceeding,” Donnelly said in the statement.  “We want to be sure that all voices are heard in this election, which is the common goal that we and the party both share.”

UPDATE: Koster has hired longtime friend and ally Chuck Hatfield as his lawyer. Hatfield is with the law firm of Stinson Morrison Hecker LLP.

Said Hatfield in a statement: “A recount is unlikely to change the outcome of this primary. The Secretary of State and the local election authorities in Missouri did a wonderful job running this election. We are confident that Koster’s victory will remain intact. However, we respect Margaret Donnelly’s right to request a recount.”
