Court dismisses most of Donnelly suit
A court review of more than 800 ballots that were thrown out in the attorney general’s race has found that two should have been counted.
Democrat Margaret Donnelly sought the review after she lost the four-way Aug. 5 primary to Chris Koster. He won by 780 votes out of more than 346,000 cast.
Donnelly is still awaiting the results of a statewide recount, which is under way. Meanwhile, she had asked the Clay County Circuit Court to review absentee and provisional ballots rejected by 26 local election authorities.
After a hearing today, Circuit Judge Larry Harman dismissed all the parties except Kansas City, which was ordered to open and count the two ballots that were wrongly rejected.
Attorney Chuck Hatfield, who represents Koster, said the two voters had disabilities and needed someone to help them with their signatures.
“For some reason, these two ballots slipped through the cracks,” Hatfield said.
According to the judge’s order, Donnelly now agrees that local authorities handled the rest of the rejected ballots properly. She agreed to dismiss the suit and waive any challenges to recount procedures.
Donnelly’s lawyer, Dick Rhyne of Kansas City, could not immediately be reached.
