Hubbard withdraws election court challenge
Here are three words that power attorney Scott Rosenblum is not used to saying: I give up.
But Rosenblum, the high-profile defense lawyer who had been representing State Rep. Rodney Hubbard’s court challenge to his narrow election loss, did just that in a motion submitted Friday.
Hubbard lost the Democratic primary for the 5th District Senate seat to State Rep. Robin Wright-Jones by 101 votes. On Aug 26., he filed a lawsuit alleging irregularities at the polls and perhaps a malicious vote-eating computer virus.
He asked for a recount, and potentially a new election altogether.
Yet on Friday, Hubbard withdrew his request for the “good of the party.”
The only matter left for Judge Edward Sweeney to decide is who will pay the other side’s attorney fees, which could be decided in a hearing Wednesday at the Carnahan Courthouse.
Hubbard does still have a sliver of hope of gaining the Senate seat — because the margin of defeat was less than one percent, the law allowed Hubbard to seek a recount.
The statutory recount, however, will take in only votes that were previously counted; Hubbard’s law suit sought to include votes that been disqualified.
