Now, here is a statement from Joyce:

As a citizen, I believe that elections should be about issues.  I also have enormous respect for our First Amendment and freedom of speech.  My sole purpose in participating in this initiative is about getting truthful information to the voters.  This has never been or never will be about prosecuting people.

Clearly there are those who are attempting to twist the purpose of this initiative for their own benefit. This attack is a great example of how the truth is distorted in campaigns and what we’re trying to stand up against.

Then, Jennifer Joyce, explain to me why the KMOV report, in which you were featured, states that the Obama campaign is asking Missouri “law enforcement” to “target” people. The report specifies and interviews you, Jennifer Joyce, along with Bob McCulloch, in your roles as “two high-profile prosecutors.” The report quotes you two as saying that you “plan to respond immediately” in your role as prosectuors.

You have just participated in an activity designed to terminate our rights under the First Amendment and I would hope that you are prosecuted to the fullest extent of the law. St. Louis is one of the highest crime areas in the United States. Your resources could better be used to attempt to do something about that issue. Regardless of who is running against you next time, I will support them with my time and my money. You obviously prefer presidential campaigning to fulfilling your responsibilities to Missouri residents so I would strongly suggest that you resign and go work for Obama without delay. You very likely have violated the terms of the oath of the Code of Professional Conduct for Attorneys and possibly some federal laws. You should be reported to the Missouri Bar for Prosecutorial Miscoduct and Abuse of Power for using your position to frighten people with a thinly-veiled threat to bring a lawsuit against those who do not agree with YOUR perception of YOUR candidate. If you said you were going to do it for ALL candidates, that might be different - but you have made it clear - this is in support of only one candidate.

This country was founded on the principle of freedom of speech and you absolutely can not imply, nor infer that you will use your position as an attorney (who happens to be a prosecutor) to bring criminal or civil charges against persons to whom do not agree with your perception/truth of your candidate.

It is telling that our forefathers made the freedom of speech our first amendment to the constitution. You state that, “My sole purpose in participating in this initiative is about getting truthful information to the voters.” But you CAN NOT impose what YOU feel is the truth by using the police and threats of legal action, whether civil or criminal, to frighten people where they feel that they can say nothing. I think you know that it would be very, if not impossible, to move forward with any sort of civil suit given all these public figures - so you are trying to use your position to scare people who do not know the law as well as we do.

People do not know what YOU think might be *THE* truth and you hold yourself out as an attorney, who by the way - “I’m a Prosecutor,” and say legal action will be taken. This in itself is chilling - as I would imagine most people would absolutely abhor the thought of a lawsuit being brought again them, civil or criminal, especially when a lawyer who works as a prosecutor says it (even if you meant civil).

Do the right thing. Do the ethical thing.

If you’re going to have a truth squad of some kind for commercials, fair enough. But a prosecutor on it? Uncomfortable. Two of them? Totally inappropriate! Totally. And I’m a vigorous Democrat! So there. Truth squad, sure; we need oversight of inaccurate commercials. But in a legal framework of independent voices, not Democratic prosecutors for goodness sake! I guess this may prove my saying, “Not your usual Democrat.” Well meaning, perhaps, and prosecutors are supposed to be good at telling fact from fancy, but not on this kind of committee. First, it does smack of intimidation even if not meant to; and worse, dumb, as they should have known it would lead to this backlash publicity for the other side. And no one listens to partisan truth squads, anyhow, so why take the risk? By the way, McCain’s truth squad in Missouri seems to have had no problem with my Sarah Palin radio commercials on behalf of my candidacy; no surprise to me.

I saw the video on the web. Perhaps the station misrepresented you. However, I do believe you should not be taking partisan political positions if you are a servant of the court. Will you be going after the Atlantic for suggesting that Palin faked her pregnancy? I grew up in a neighborhood that was populated by survivors of work camps in Poland and France during WWII. Suppression of free speech was one of the first steps of totalitarian regimes whether they be Fascist or Maoist. I really don’t want our country to go down the road of Venezuela or Zibabawe. Hey, goofballs. The First Amendment does not protect false or misleading speech. This is why, for example, the state can prosecute false advertising, fraud and the like. Therefore, if you use the public airwaves to disseminate an ad that is demonstratably false, it is not protected by the first amendment. Admittedly, if you are dealing with a public official the ad has to show a reckless diregard for its falsity, but if that can be shown, then the ad is simply not protected speech.

That said, can any one of you give me any evidence that anyone has been prosecuted by an “truth squad” here in Missouri (or by McCain’s truth squad in NH for that matter) or intmidated in any way from spouting lies. Looks like you guys are managing just fine.

Let me give you an easy example of this whole truth vs. false thing so even your Rush-addled brains can grasp it. Let;s say I were to run an ad saying that McCain is an adulterer who left his crippled first wife for a beer-heiress in order to further his political career. Now that would be a true and well-documented statement and therefore fully-protected by the First Amendment. However, if I were to run an ad saying that Sarah Palin was possessed with evil spirits, that would clearly be false because we all know she had a preacher lay hands on her and exorcise those spirits back in 2005. I mean we all saw that on utube. So that statement would not be protected by the First Amendment.

Well, at least Ed Martin finally got a “real” job with the American Issues Project after he royally screwed up with Blunt’s email gate.

Your personal belief is not at stake here. You are using the power of the office of your public position to coerce individuals to vote for Obama or to leave the impression that if they speak, write, campaign in any manner that the full weight of the law will descend upon them. No matter what you think, that is what your are conveying as result of your ill chosen path.There is a sign on your door which appears in the Clip which says it all.. Insuring that nothing which is derogatory about Obama seeps through the cordon of a phalanx of self appointed ministers of what constitutes allowable political speech is beyond the pale. Both of you an all others involved have injured the Constitution of this country and done a gross disservice to the people of Missouri. Hi, Missouri, I live in PA, and the Obama attorneys are all over our radio and TV stations threatening to sue if they play ads generated by the NRA about Obama’s history on gun control. The NRA has the facts to back up their ads, so we will see what happens, but I find their lawsuits very strange coming from a campaign whose ads in PA have either been filled with lies or have comments by McCain taken totally out of context, which is another form of lying. I am a Democrat voting straight Republican this year, as the thought of this Obama thug as POTUS chills me to the bone.

I don’t care how Ms Joyce wants to term it or how she distorts it. Americans have the 1st Amendment right to Freedom of Speech unless it incites civil unrest. Even an untrue ad about either candidate does not meet that standard. More pointedly as an attorney she knows that.

NEVER before have candidates like Obama threatened to prosecute anyone who opposed them. Put out your own ad, but using the guise of legal action is reminescent of Nazi Germany or Russia. If Americans value the Constitution and their freedoms, they need to stop this. All nations that removed citizens’ freedom started small and built.

Look around the country, Democrats suing groups like NRA, disrupting radio broadcasts in Chicago, banning rally signs on a VA campus…where will it end. Free Americans can get information for both sides without the government playing parent, Ms. Joyce.

I am so glad there is no killings, robberies, rapes or thefts in St. Louis that needs prosecution skills these days. A few years ago when I lived in St. Louis there were a lot of crime that needed to be taken care of, apparantly all of the criminals have been put in jail.

This is the most inane thing I have heard about in a long time. Anything these two prosecutors want to do in their own name is their right but when their titles, along with the other officials including “sherrifs”, are brought into the forefront it is, as others have said, the beginning of a police state. The outstate people own’t stand for it and the people of St. Louis and the other counties where this is happening should rise up and let these public officials know they are not to stand for it either.

I am so disgusted by this, and disappointed. I sent Joyce, McCulloch, our state senator Claire and also our sheriff’s dept in Boone County an email last night telling them if they were involved in this type of police (gestapo) tactics, that they should be investigated. Now they will probably try to shut me up too.Obama says he is a different kind of politician, yes that is for sure, the worst kind. If you are so insecure, and can’t stand the heat of the campaign without trying to shut people up, you must have something to hide. Same tactics he used in Chicago to move up. Freddoso’s book is exactly right about Obama. Now we know who he really is.

These out of towners will not haunt this blog after next week when all of this proves to be yet another ineffectual attempt to change the prevailing messages about the campaigns. These butt-inskies are not the story, no matter how much they wish it to be so. The story is that some elected and appointed officials are supporting Senator Obama, which may mean using their voices to come to his aid when McCain-Palin come after him with lies. Fact is, we should have had more (even one?) truth squads operating when Kerry got swiftboated in 2004. You have to speak truth to power, and the real effective truth messengers are those with some power of their own. I think truthfulness and a very healthy respect - even advocacy - for the truth are admirable qualities for prosecutors and law enforcement officials. I am glad to see some of our finest standing up for the truth.

“They plan to respond immediately to any misleading advertisements and statements that might violate Missouri ethics laws.” That quote is from John Mills’ story, tho not a direct quote in the story, so must be a paraphrase. My comments: if that’s not a threat of prosecution, I dont know what is. Second, not sure whether Missouri Ethics Commission has authority over federal campaigns; if there’s a federal law, it probably preempts; if not federal law in point, still wonder whether they have authority over federal elections in this respect; might have to do with what ethics law says. And finally, dont think prosecutors can directly prosecute without first a finding by Ethics Commission that there’s been a violation. Conclusion, if that quote is paraphrase of what Joyce or McCullough said, it seems inappropriate on several levels and meant to intimidate. Now if they have authority to prosecute, then maybe it’s appropriate, but they’re not going to prosecute for nuance or over-simplification. And if they’re just there to tell the truth, reference to Ethics Law inappropriate. Cant have it both ways. I’d like to see them get off the committee. Key question: lies dont come any bolder than “thanks but no thanks”; so if they arent going to indict Sarah Palin, who and what do they intend to invite. Ladies, gentlemen, I want us to win, too, but you guys need to get back to your day jobs.

I’m sure Ms. Joyce has enormous respect for the 1st Amendment as does Mr. McCullough WHEN IT IS ONE OF THEIR OWN. Anyone else, that is another story.

What I see in her response is a rat scurrying around when the lights are turned on. Not a very pretty picture!

I suggest Ms. Joyce go back and read some of Alexander Solzhenitsyn’s work such as “One Day in the Life of Ivan Denisovich” or “The Gulag Archipeligo”. Then she could see the real effect of Stalinist policies.

Tim Hogan’s links to dangerousintersection.org is fine if you first keep in mind that it is self-avowed left of center propaganda. It uses Huffingtonpost as a SOURCE OF INFORMATION! Good Grief! I’m a poster on Huffington and the stuff I see there boggles my mind.

If people want FACTS as opposed to FICTION or LIES, you have to go to analysts such as:

The type of fact checking these sites do is clearly spelled out, emphasizing primary sources, direct contacts with officials or people who would know … like the original person who said it, etc.

The ability to see the difference between a site like Tim Hogan’s link and these fact checkers is critical to help people differentiate fact from opinion.

Please, please use these sites. You’ll soon see that McCain and Obama are tit for tat when it comes to distortion. And Hillary started it all with Media Matters. Sorry, but lying isn’t a Republican thing. And Obama ain’t for changing none of it!!

The language mechanics here might be a tip off that these are not locals or Americans posting. It would be interesting to have this site do a study of the IP addresses of posters like D.Walker and find out where in the world they are coming from and who their Internet Service Provider is.

I like topix.net/forum for instance because they include that information for each poster. You see me as posting from San Diego, CA. But at least you know where I’m coming from even if I never gave that information. No one can hide that they are from Toronto which would be a big source for these pro-Obama comments or even as far as Kenya which is rumored to be another big site for pro-Obama posters. I’ve heard Obama has major campaign funds going into saturating sites like this with disinformation and smears. These people usually use bully tactics to intimidate. You can see the words “evil” and “stupid” in the post above. Intelligent people just give the facts, never mind all the character defamation.

I’ve noticed that my local papers have been infiltrated. All the local posters know each other. We use lots of local references and have been around the town a time or two. But when an article comes up about McCain, for instance, suddenly the strangest new names come up and the language becomes downright offensive. I’ve seen whole pages of comments without a single name I recognize, all screaming unbelievable garbage about McCain.

Watch for it. Quite interesting to see phenomena like this occurring. I’ve been using the internet and logging in many sites since 1995 and what’s happening is creepy.

McCain’s not the source of this. This is different. And my logical, intelligent friends who are voting for Obama need to explain it to me.

Regardless, why hasn’t this been in the paper? We know the Post has a left wing editorial position, but they are up front about that. I can live with someone who is honest about it. But, for the news dept. not to even report the story, even if they don’t believe it, is irresponsible and shows a slant. The fact that it has become a National story requires that it be covered, even if your goal is to discredit it. Almost an entire week has gone by and nothing. Journalism as we know it is dead. Our local paper ingores a story that is now being reported by the MSM and is featured on most of the National news blogs is amazing. This will be another embaressing chapter in St. Louis politics this week as the National media visit St. Louis.

Oddly enough, we still don’t know exactly who it was that called from the BHO camapaign staff, who they actually talked with, the exact conversation that took place, when it occured or who in the city and county governments authorized the prosecutors to make their public pronouncements.

I’m not surprised by all the personal attacks from the BHO supporters. The prosecutors conduct and participation is despicable. This speaks volumes about the future of Democratic politics and the suppression of dissent in American political discourse. The DNC must be reading the Hugo Chavez play book.

I’m surprised that BHO hasn’t unleashed his pet community ‘activist’ program to instigate demonstrations against Senator McCain and Governor Palin ahead of the upcoming debate here in St. Louis.

Utilizing law enforcement to intimidate and suppress political dissent is just plain wrong. I did watch the video and I did hear the pronouncements.

I strongly recommend the Post Dispatch review the content of all these online forums.
I am an experienced poster here to recognize the few “regular” posters style.

During the last several days the tone and style of the overwhelming number of posts has changed dramatically especially in this forum and those I’ve to below.

I believe these forums have been infiltrated by paid posters with no desire to allow any exchange of ideas, rather a desire only to disrupt and post their toxic material in such volume as to discourage legitimate posters from even trying to participate.

These many new posters provide content I interpret as coming from the extreme right. Their tactics also include using handles with unusual sounding names in posts supporting Obama. I would like to know just what “truth” was distorted. You spoke very clearly to us and we are not stupid. You might have gotten away with this strategy had you had included all presidential candidates in your great quest to get truthful information to the voters. Are you nuts? Didn’t you think for just a moment that this might just be against the rules, even in your job? Are there no Democrats who find it strange that there are so many areas of Obama’s life that have to be defended, areas that won’t go away because no proof has been given to the contrary? Personally, I’m still having trouble with his name, let alone what it implies. I have spent hours researching, trying to find someone, somewhere, some website, which gives me the proof I need to lay my questions to rest. There is no information. This man has taken this country to a depth so low that I’m afraid it will take years to mend. I live in Memphis, TN, and I can tell you we have a serious racial problem here. Obama is not helping. I just hope that if something awful happens to the man, it is not done in this city. MLK will haunt us forever.

The real way to stomp on these fascist obamabots is to go after them directly and not ever let these traitors to American values walk away or let the issue fade in any of its manifestations, particularly the use of public office and authority to “thug” or intimidate anybody. A subtext of police authority is state and police “discretion” making your life uncomfortable. Everybody knows a story of this, so the threat is plausible. An ethical DA would never get involved in overt political activity on one side of an election. This is really unprecedented in my experience.

How any Jew can vote for a politican who persistantly tries to silence dissent using proxy thug squads (e.g. makes implicit threats against many TV and radio stations) is beyond me. It reeks of 1932 in Germany.

I wouldn’t be here if my grandmother hadn’t gotten the hell out of Poland, but we Americans are not a minority among a hate filled majority. This is really the far left, public employees and academics, all of whom are already on the public teat and want more of everything. But this is our country…we just can’t run away from these bums. This fight needs to be taken to them, enemies of our treasured freedoms, and now is the time. For starters, stop taking to people who agree with you. Instead, write, complain, write some more…demand action on and against these brownshirts. Write the Missouri Attorney General and write the US Department of Justice. I did, it didn’t take long. There is nothing new about the way Obama is covering his ass in this campaign - with thug tactics, threats of lawsuits and now intimidation by local law enforcement. here have been many reports from the ‘behind the scenes’ of the Obama campaign. Threats of law suits are growing rapidly. He has spent a half a billion dollars trying to get elected. It is appearing that a large portion of this mass of wealth is being spent on strong arm tactics. The MSM’s silence is deafening.

See what I did there, Jennifer? I used the media’s quisling words like “some might say” and “there are rumors” to allow me to say whatever I want. And they say you can’t teach an old dog new tricks. Looks like you can’t touch me for this one.

But, to show that I’m not afraid of you and your fellow brown shirts, allow me to say this -

Barack Obama will be a disaster for this country. His economic policies (where he can bother to take a stand) are wrong. His social policies (again, the few times where he’s bothered to have one….like his wholehearted support of murdering children that survive abortions) are wrong. And, on a personal note, the way he says “Pakistan” pisses me off.

Wow, what an embarrassing situation for Missouri to be in. to have Jennifer Joyce ”watching” everything you do say or do in support of Senator McCain is not only frightening, it is probably illegal if she decides to take action against you. This is the United States of America and we live under our beloved law of the land, the Constitution of the United States of America and the Bill of Rights. Free speech and Freedom of Assembly are chief among those rights. Ms. Joyce says, ” there are those attempting to twist the purpose of this initiative”, the only thing being twisted here is the law of the land!

This is no surprise considering that a couple years ago, a tv movie was put out called “Path to 9/11″ when certain democrats in congress threatened to yank ABC’s broadcast license if they showed the movie - which put former president Clinton’s decisions in a bad light.

St. Louis Circuit Attorney Jennifer Joyce’s public involvement in Obama’s “Truth Squad” displays complete and utter disregard for the mission of her office, “To pursue justice for all citizens within the highest standards of ethical behavior and professionalism.”

Her job isn’t to defend Barack Obama against inaccurate claims or character attacks. If she wants to make it her business, it should be to defend all presidential candidates against the same.

I make no distinction between McCain or Obama, “Truth Squads.” If you’re a member of law enforcement or the court system, you have no business abusing your office to intimidate citizens from utilizing free speech. And if you’re going to do it, you sure as hell better be non-partisan in your dealings.

Whether or not it was the Circuit Attorney’s intent to intimidate Republicans, she has made many citizens uncomfortable via her unwillingness to defend all candidates. In doing so, she causes the public to lose faith in our justice system.

Through her partisan actions while a prominent member of our circuit court, she has sullied her reputation, her office, and the city of St. Louis. Until she apologizes for this injustice, she leaves a stain on us all.

These defences are foolish. I just finished 30 years of military service (mostly reserve with 10 years total active) I was medically retired due to injuries (non-combat) received in Operation Iraqi freedom. In the civilian world I worked in law enforcement on several occasions. The idea that a Law enforcement official would endorse a candidate (using their position as a platform) let alone start a organisation like this is sick. As puplc officials we should not be seen as biased. What this unethical person does in her private time is her bussiness. But to state that she never said they would prosecute is not the issue. If Bush had started “truth squads” the ACLU would have gone crazy and rightly so. Who is to decide what the truth is.. this Stalist… I do not think so!
in my years of service I have met many fine people who gave thier very lives to protect the Constitution.. This person has whored herself to a political campaign and has disgraced the true defenders of free speach she should be fired.
