Ill. reps bravely address nudie-pics issue (Still no state budget or ethics progress. . .)

SPRINGFIELD, Ill. – With about 36 hours left before the Illinois General Assembly’s constitutional deadline for passing a new state budget, lawmakers still haven’t started their final debate on it. They haven’t come to agreement on Gov. Pat Quinn’s proposed tax hike to fund it. Nor have they yet completed their much-touted overhaul of state ethics standards to prevent yet another governor from ending up in the federal clink.

But at least they’re making headway on the issue of nude Internet pictures.

A pending bill (HB2537) would make it a misdemeanor to upload nude photos of a person without the person’s written consent, “with the intent to injure the reputation of the other person or with the intent to cause emotional distress to the other person.’’

It’s gone through both legislative chambers, and still needs one more House vote. So far not a single lawmaker has voted against it at any level, despite some wording that calls into question just how effective it will be. (Only the initial upload of the photo would be illegal; once it’s out there, anyone who finds it can still view and forward it at will. Also, regarding the “intent to injure’’ provision: Does that mean it’s not illegal as long as you claim that, gosh, you just didn’t know that your ex wouldn’t have wanted you to post those photos from your Reno honeymoon? . . . )

The House is meeting now and the final nude-posting vote is expected at any time. We’ll update it here. (We’ll also update it if they happen to get around to passing a state budget . . . )

Kevin, you can make all the jokes you want about this … but if you don’t think there aren’t people out there for whom this is a serious issue, let me welcome you to the 21st century. Personally, the only complaint I have here is that is shouldn’t be a misdemeanor, it should be a felony with sex offender status.
