US Fidelis settles Verizon suit; AT&T going after “John Doe” firms

If you missed it, there’s a story in today’s paper by Elizabethe Holland about a settlement in the lawsuit by Verizon Wireless against US Fidelis, the Wentzville-based broker of extended auto-service contracts.

As part of the settlement, the company is banned from making unsolicited calls to Verizon Wireless companies. US Fidelis says that’s no problem, because it maintains that it hasn’t made unsolicited calls to anyone in several months.

Also banned is Voice Solutions, the Florida-based telemarketing company US Fidelis used to make the calls, Verizon representatives said. Both also agreed to pay $50,000 each to Verizon, half of which will go toward legal costs and the other half to a charity, said Leigh Schachter, assistant general counsel for Verizon, which is based in Basking Ridge, N.J.

US Fidelis admitted no wrongdoing. The company settled the case to avoid a costly legal battle, a spokesman said.

Verizon also is suing two similar companies based in St. Charles County: National Dealers Warranty, based in St. Peters, and Dealers Warranty, which does business as Federal Auto Protection and is based in St. Charles. Also, it’s worth noting that Verizon isn’t the only wireless company suing the service-contract industry for allegedly making unsolicited calls to customers. In January, AT&T Mobility filed suit in a Georgia federal court against four “John Doe” companies for allegedly cold-calling AT&T customers in order to sell them extended auto-service contracts. (The companies haven’t been named yet, so there’s no reason to believe US Fidelis, National Dealers Warranty or Dealers Warranty are involved in the suit.)

These are pretty normal problems any companies will face who make unsolicited telemarketing calls, especially those that hire many of the wrong third party telemarketing companies to carry out telemarketing services for them.

Just because the company is Verizon doesn’t make it hold any different kind of water because even Verizon has been bogged down in class action lawsuits against them ,even settling out of court for deceptive practices against their customers.

ATTENTION ALL FORMER US FIDELIS EMPLOYEES::::

PLEASE EMAIL ME IF YOU WERE WRONGFULLY TERMINATED.

I already have several former employees if you were fired there is nothing else US Fidelis can do to you.

1. If you were forced to lie or lose you job. Can’t call back, one time offer, we are on direct pay with the dealers, making you sell a warranty to someone you did not need it, ect.
2. US Fidelis state you resigned when you were fired and they are fighting your unemployment and cobra reduction.
3. Anything else you might have to add.

To the ” unamed person” who is allegedly starting a lawsuit. Tamara Lucas, why would you go on national television and bold faced lie to the american people? As for as I know, you were never on the actual sales floor, and if you were it was not very long. So how would you know if we are ” forced” to say anything. All of those things are said to help create urgency for a customer. If the customer is smart they always know that they can call back. However, they also know that if they wait too long, they may have too much mileage to qualify for the best coverage and might have to settle for less. If you ACTUALLY worked on the sales floor, you would know that the insurance backers have guidelines on how we can offer the warranties. Platinum coverage CANNOT be offered to a vehicle over 50k miles, 60k in some states. Gold coverage CANNOT be offered to any vehicle over 100k. So you see, with the sense of urgency created we help to make them understand that a small investment now, saves them money later. Again, if you were actually on the sales floor and not in customer service or collections (like you) you would know these things and know that you were not telling the truth.
2nd lie, I was forced to resign cuz I did not like what was going on there and I could stand to work there anymore. You know in your heart of hearts why your job was terminated. If you do not have the intestinal fortitude to simply move on and go find other meaningful employment, I feel very sorry for you. The fact that you feel that it is right of you to try to feed your family by suing someone vased on YOUR mistake is absolutely disgusting. I hope your family knows everything that you are doing.
Thirdly, in regards to the lawsuit. You said on national TV and I quote ” I was TERMINATED from my job because I did not do what they wanted” That really makes your lawsuit null and void in regards to COBRA and such. You cant go to COBRA and say you resigned and then tell a NATIONAL TV auidence ON TAPE that you were fired… do you think that really makes you credible here?? No it simply makes you someone who is bitter because she lost her job… Tamara do you and your family a favor, just move on. Get a job and just take care of your family.

loveshisjobthankyouDarai…You obviously don’t know me. Yes I was on the sales floor I would be happy to name my managers if you like. Yes, I was fired. I never said I was forced to resign. The company lied and said I resigned. I did and have not lied about anything. I can leave that up to you and US Fidelis.

You don’t have to remind me of all the coverage’s or sales information. I know it well and if I need to refresh myself I can refer to all my updated training material and company memos. When my manager boxed my belongings and took (stole)my sales commission sheet. She was so worried about the money but she forgot to cover the company’s assets. There are many people enjoying reading all this information. My suggestion to you if you work in sales keep you sales sheets with you at all time unless you like working for free.

You stated if the customer is smart they know they can call back. You are basically stating if a customer believes they cannot call back they are stupid and they are fair game? Shame Shame?

I did not say that on TV I have a copy of that if you would like to see it. Maybe you are confusing it with the newspaper article. Brush up on your facts.

My family is proud of me for standing up to such a despicable company and I have received many kudos from employee’s still working at US Fidelis. These employees would love to be able to make a honest living and US Fidelis is capable of conducting a honest company. US Fidelis got greedy.

As far as Cobra you do not even comprehend what is all about. I am on Cobra and was referring to the Cobra reduction offered for President Obama. Really do your homework. I do! You are really good at talking in circles you should apply for the CEO job because he is pitiful.

I am moving on after a few court appearances and I will be done.

Please spell my name write. US Fidelis had that problem too!

Hey ….Don’t give Ms. Lucas all the credit for these posts. She is not the only person who dislikes US Fidelis! Also, on this blog, I could say I was Santa Claus and you would not know who I really was. Get real! Why would anyone post: ‘I think you are the black lady, the white lady, or the heavyset lady that was on the Today Show?’ How would you even know? Perhaps ‘I’ still work at US Fidelis and made remarks that persuade a reader to think I am one of those people——–Maybe I am a manager from US Fidelis that makes a $10,000 bonus each month–Maybe I am a former employee who found another job—Maybe I am a wife or a husband of an employee.– Maybe I drink beer with some of the management and when they got drunk they spilled the beans on USF.– We never know who is REALLY posting on here. ***Now excuse me while I go back to selling extended service conracts. We just aired our commercial for the 4th time this hour; and I have an elderly customer who needs a warranty on his 1996 Chevy Lumina.*** (Warranty price $1995; blue book value of car: $1745. I hope their kids don’t find out that the contract only covers up to Blue Book Value.)

What the heck? LOL

While in training class I listened to a manager take over a call to persuade a customer to not cancel his warranty. This manager bold face lied to the customer when she said ‘…wouldn’t you want to keep your investment protected by a company that has been in business just under 20 years?’ THAT is a bold face lie; I hear that one used all the time at work. US Fidelis/Dealer Services/National Auto Warranty Service has been in business under TEN years—-NOT TWENTY. This is one of the reasons the company is in trouble. If the product/coverage is good; why the need to bold face lie?

Lie like a rug/////i know the answer to that question. I was told in a coaching session when I ask why to we tell he customer we have been in business for 20 years? I was told because the warranty we sell one of them has been in business for 20 years so we at USF can claim we have been in business for 20 years since they have been in business for 20 years. Sssoooooo lie like a rug you lie like a rug.

Tamra (and I applogize for misspelling your name),
I understand you are upset for getting terminated. But did US Fidelis unlawfully term you? If not , why are you so upset? BTW if you are terminated you are not entitled to ANY comission money from that point forward. Comissions are like bonuses in the fact that you need to be employeed at the time comissions are given to actually receive them. I did do some research and I did find out that yes, you were on the sales floor and consequenseally not very good at it. And that is ok, not everyone is cut out for this business. Yes there are things that we were trained to say that were not altogether true… true our company has only been in business about 10 years… the insurance companies that back our warranties however HAVE been in business an average of 12 years or more, most more than 20. I agree there, that needs to be worded differently and I myself have changed how I explain that.. it makes sense.
Nobody has robbed you of anything Tamra, nobody owes you anything Tamra.

If you got terminated for just cause, accept it and go on. I was terminated from Best Buy for just cause and I did not like it. I could have all the things you are doing and got nowhere just like you. But I did not, I picked myself and got a new job and have been there ever since. You are a grown woman, please stop acting like a child.
