Fox News: Man behind US Fidelis robo-calls had criminal history
The Florida company that placed more than one billion “robo calls” on behalf of Wentzville-based US Fidelis is owned by a convicted felon whose rap sheet includes charges of trespassing, battery, firearm violations and calling in a false bomb report, Fox News reported today.
James Dunne, 36, owns Dayton Beach-based Voice Touch, which was sued last month by the Federal Trade Commission for work it did on behalf of Transcontinental Warranty, a broker of extended auto-service contracts.
As reported first in the Post-Dispatch on May 15, Voice Touch had previously worked exclusively for National Auto Warranty Services, which changed its name this year to US Fidelis. In that story, Dunne said his firm had placed more than 1 billion calls on behalf of the Wentzville firm. A May 24 Post-Dispatch story took a closer look at the relationship between Voice Touch and US Fidelis, and the story told how Philip Jehle — US Fidelis’ former chief financial officer — had warned Dunne and US Fidelis President Darain Atkinson that the two companies seemed to be breaking federal telemarketing laws.
US Fidelis has said that, when it hired Voice Touch, the firm agreed to follow state and federal laws. US Fidelis seems to have cooperated with the FTC investigation of Voice Touch.
Today’s Fox News item states that a US Fidelis statement dismisses Jehle as “disgruntled” former employee.
The report focuses on Dunne’s criminal past, as well as the 1993 robbery conviction of Damian Kohlfeld, who Fox calls “the technological guru behind the massive scam.” Kohlfeld allegedly developed Caller ID “spoofing” technology used by Voice Touch to hide the origins its calls.
It’s not clear whether Kohlfeld worked with Dunne when Voice Touch placed calls for US Fidelis. If he did it’s unlikely anyone at the Wentzville firm would have raised a stink about the old criminal conviction. Atkinson, after all, is a convicted thief, burglar, check-forger and counterfeiter.




You sound a little disgruntled yourself, Hathaway. I asked about this before, but it was on an old post, so you might not’ve seen it: What’s with the vendetta?
You’ve even posted pictures of US Fidelis on news stories that had nothing to do with it. The industry as a whole seems to bother you a bit; but US Fidelis in particular annoys the crap out of you. Why is that? Is it something personal?

Not only are such comments unprofessional and unbecoming but also of course with people like Hanaway, it appears, ex-cons and those who have had run-ins with the police are not deserving of considerable treatment. He appears to despise people with criminal records and who make efforts to rise above them, and he certainly do not think they are deserving of making more money than he and rise to be rich. This technology never became questionable until recently when the no-call lists came into law. But, it was legal technology that this awful person with a criminal history had the nerve to have the brain to develop.
Unlike Matthew and others who is too sick in mind to see nothing but bad, I see brilliance in this person. It will be brilliant minds such as this man’s with the ooooh, (criminal record) that will develop new technologies and jobs in this country.
Honey, it doesn’t take much of a human being to paint ugly pictures of people as Matthew loves doing because there isn’t a person alive who can’t be made out to be a monster. Well, there may be only a rare few because one just popped into my mind but even he wasn’t as a young man in his early twenties who is now in his eighties, but even those are stories I have heard from other people.

Does Fox News have a grudge/vendetta against the industry as well?
Why is it so hard to understand the nations anger with US Fedelis? Two years ago under their other name they were brought up on charges by the Missouri Attorney General. They were forced to refund thousands of dollars to customers and given a fine. So what do they do change name and still do the same garbage and rip people off.
As far as the criminal comments haven’t you ever heard a lepord can’t change it spots. Should they be rewarded with coming up with new ways to commite crime?
The industry in a whole is not bad. I know this first hand. The problem comes from companies like US Fedelis who does things like this and then consumers have a bad taste in the mouth in general. These warranties are a very good thing for consumers. Especially in the economy today. No one ever knows when a vehicle is going to break down and these warranties can save people thousands of dollars. When people are losing their homes what heppens when they have to car too?
US Fedelis deserves everything they get. They plotted and planned how to get around laws and take from people. That is always wrong and who suffers as usual from criminals? US!
D Walker, You forgot an important adjective when describing Mr. Hathaway’s comments regarding Atkinson’s criminal history. Your opinion is that Mr. Hathaway’s comments are “unprofessional and unbecoming.” You neglected to mention however that those comments are also TRUE. Afterall, isn’t the primary responsibility of a journalist to uncover and report the truth? With respect to your legal analysis, it is deeply flawed. The Federal No Call rules have been on the books since at least 2003. That is hardly a recent development. In addition, the No Call Laws were highly-publicized, and existed as Federal law for at least 4 years prior to Atkinson’s alleged violation of those laws. The other laws that have been reported to have been violated by Atkinson, (robo-calling, spoofing caller ID’s, etc.) have also been on the books for many years. Finally, you assert in your post that Atkinson “developed” the technology used to allegedly violate all of these laws. I don’t know how you drew that conclusion because the Fox News story stated that Atkinson hired another convicted criminal (Dunne) to implement the technology developed by a third convicted criminal (Kohlfeld). So your “brilliant minds” adoration of Atkinson seems very misplaced. I agree with Frustrated’s post. This is a simple story which you have tried to derail with attacks on the Post-Dispatch, personal attacks on the journalists, and a whole bunch of inane blathering about Satan. I can’t speak for the other readers of these posts, but you have certainly worn me out.

I watched the story on Fox News today and must admit that Fox coverage was not at all as tabloid as those media outlets known as Liberal.
There are many talented and great minds and awesome people who have had run-ins with the law including prison time. Take Steve Madden for instance, great talented man who happen to have done a very bad thing and ended up in prison and is out doing great and running a successful fashion empire.
But evil, malicious self-righteous people, (but of course they don’t see themselves in this light, lol) will always try to throw one’s pass in their face, a few media types attempted to do the same thing with Steve Madden. These type of people will never be able to tire down people like these who will always rise above it because they are not evil bad people, just people who did some very bad or dumb things or just got caught up in something but most importantly, and because secondly, they know who they are and believe it and don’t have low self esteems like sadly too many others who can actually be mentally destroyed by people with the evil tabloid mentality. These are people with a special greatness to them who do use their past for good to uplift others who are or have gone through bad times, even criminal pasts.
People like Steve Madden and Akinson are usually are very talented, extremely smart, some are truly genius but most of all they all usually have very big hearts. They are not at all ugly people who do big things just for show. I just wish that I had the power to cause all people to believe in themselves no matter who they are, where they are or where they have been.
One last thing, if you do have a criminal past, you have better find something to bring you income legally and on your own and not depend on anyone else to employ you. Our landscaper has a criminal past and in conversation he shared with us this.
Years later he is still our landscaper and does great work and have our lawns looking like one of the best if not the best from the worst in our subdivision. He has taught me many things and now I have become a fanatic out there always doing something in the yard.
