Court ruling clears the air in DWI cases

The Missouri Supreme Court on Tuesday cleared up confusion surrounding certain cases that were in limbo during a challenge to the state's DWI law in 2008.

The Attorney General's Office said it believed the ruling would apply to a small number of cases and would not affect future cases.

In March 2008, the court ruled that because of an ambiguously worded statute, authorities could not count certain types of DWI cases as prior offenses to enhance penalties on a new DWI charge.

The Legislature fixed the law a year later, letting prosecutors resume counting those cases as priors.

Questions remained about some felony DWI convictions that were on appeal at the time of the court's ruling in 2008.

In its 5-2 ruling Tuesday, the court reversed a felony conviction and sent the case back to the trial court. The ruling said prosecutors could not at the rehearing present evidence of other prior offenses to make up for cases which no longer counted.
