Ukraine is an increasingly popular choice for intended parents from around the world considering surrogacy. One reason is robust legal and medical support for assisted reproductive technologies (ART) at the legislative level. Programs here are available to international couples, and parental rights are protected by legal contract. With high standards of medical care, successful pregnancy and delivery through surrogacy occurs in 80–90% of cases. This can create a realistic path to parenthood supported by both law and medical excellence.

International Couples: Access to Programs

Under Section 6.8 of the Ministry of Health Order â„–787 "Procedure for Applying Assisted Reproductive Technologies in Ukraine," international couples have the legal right to participate in various ART programs on equal terms with residents. The list of indications for surrogacy and required medical screening applies uniformly to all participants. It is clearly outlined in law and publicly available.
To begin with a clinic, you need just 4 documents:
- Application form
- Passport
- Marriage certificate
- Medical report
Specialized agencies help intended parents find a surrogate and finalize the agreement, select a clinic, and manage the entire process. An agency contract outlines program stages, services provided, and total costs — with no hidden expenses.
When registering your newborn, you are listed as the parents on the birth certificate immediately. This eliminates unnecessary court proceedings and provides you with clarity and security from the moment you begin the program.
Because there are no unpredictable expenses, costs are accessible, and parental rights are legally protected, approximately 2,500 international couples choose surrogacy in Ukraine each year.
Standard of Reproductive Medicine in Ukraine
Ukraine's ART development began over 40 years ago. The first in vitro pregnancy occurred in 1984, and the first child born through IVF was delivered in 1991. This marked the beginning of rapid development in reproductive clinics. Today, Ukraine ranks among Europe's leading countries in the number of successful births through assisted reproductive technologies — over 50,000 children.
Level of Medical Services
High-standard medical care enables a wide range of complex procedures: from testicular sperm aspiration (TESA) to intracytoplasmic sperm injection (ICSI). This significantly improves outcomes even for couples who have had unsuccessful attempts to create their own embryos. Genetic screening such as PGD can identify any developmental abnormalities before embryo transfer.
Standardized Protocols
All surrogacy procedures and programs in Ukraine are standardized according to clear, medically validated, and approved protocols. Egg retrieval, sperm collection, and all procedural stages follow international standards. Ukrainian law establishes official requirements for donors and surrogates — their health status and absence of harmful habits are continuously monitored.
Clinic Equipment and Personnel
Reproductive medicine clinics meet specific medical standards and feature modern equipment as required by Ministry of Health Order â„–787. Ukraine has the Ukrainian Association of Reproductive Medicine, which brings together reproductive medicine specialists. Some specialists have over 25 years of experience. This means you can access qualified, contemporary care in surrogacy.
Process Transparency and Control
Annual reports from the International Committee for Monitoring Assisted Reproductive Technologies (ICMART) confirm that Ukraine is among the most active countries in ART use. The key advantages of surrogacy in Ukraine rest on four essential components:
Beyond these legal safeguards, there is widespread societal acceptance of surrogacy in Ukraine and an adequate supply of donors and surrogates who provide excellent support — creating a reliable and transparent process you can trust.
1. Binding Contracts — An agreement between intended parents and the surrogate is signed before any medical procedures begin.
2. Structured Process — Cooperation includes a preparation stage (selecting a program, donors, surrogate, and signing the contract), genetic material collection and fertilization, embryo evaluation and transfer, pregnancy, delivery, and documentation. Payment is also structured in stages.
3. State Oversight — The Ministry of Health licenses medical centers and inspects IVF laboratory equipment. Donor records are maintained, embryo culture protocols are documented, and cryopreserved egg storage and use are logged. The Ministry of Justice oversees legal procedures.
4. Clear Birth Registration Rules — Required documents include a declaration from the intended parents, a medical birth certificate, and proof of genetic relationship between the child and one parent. The surrogate has no legal right to challenge parentage in court.
Beyond these legal safeguards, there is widespread societal acceptance of surrogacy in Ukraine and an adequate supply of donors and surrogates who provide excellent support — creating a reliable and transparent process you can trust.
How Surrogacy in Ukraine Differs from Other Countries
Globally, surrogacy has no unified legal status — regulations vary dramatically by country. For example, of 195 countries worldwide, surrogacy is prohibited in 70, and unregulated in over 90. Of the remaining countries, 70% permit only altruistic surrogacy (no compensation).
Ukraine is among a small group of countries (fewer than 10) that:
- Legally recognize contractual surrogacy in legislation
- Establish parentage administratively, without court proceedings
- Do not recognize surrogate rights to the child
This means surrogacy programs in Ukraine are legally predictable and transparent, with clear rights and responsibilities defined from the start.
